Regulations for Participation

• Tourist-oriented services eligible for TODS shall include businesses deriving a major portion of their income or visitors from motorists not residing in the immediate area of the activity and whose activity can be classified under any of the following general classifications: Cultural, historical, recreational, educational, or entertainment activity; or a commercial activity which is uniquely local or indigenous in nature
• Be open to all persons regardless of age, race, religion, sex, or national origin
• Comply with all federal, state, and local regulations for public accommodations for health, accessibility, sanitation, and safety
• Provide adequate off-street parking to handle visitor demand on a consistent basis
• Open during regular business hours at least 5 days per week for at least 8 consecutive months per year
